Introduction
These Terms of Use (the "Terms") govern your access and use of the Learning Management System (the "LMS"), Brook Learn, provided by Brook in partnership with Eggu.
Definitions
"Account" means your individual account on the LMS.
"Content" means any text, graphics, logos, images, videos, audio files, or other materials available on the LMS.
"Course" means a learning program offered on the LMS.
"User" means any individual who accesses or uses the LMS.
"You" or "your" means the User accessing or using the LMS.
Acceptance of Terms
By accessing or using Brook Learn, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree to these Terms, please do not use Brook Learn.
Accessibility
Ensuring accessibility is a top priority. Brook Learn is designed with inclusivity in mind, aiming to provide a seamless and enjoyable experience for all users, including those with disabilities. We strive to meet or exceed WCAG (Web Content Accessibility Guidelines) 2.1 AA standards and are committed to ongoing improvement. If you encounter any accessibility barriers, please do not hesitate to contact us so we can address your concerns.
Account creation
Brook Learn is intended for use by professionals aged 18+ and is not a learning resource for children. By creating an account, you confirm that you meet the age requirement.
You agree to provide accurate and complete information during the account creation process.
User Responsibilities
You are responsible for keeping your login details (email and password) confidential and you agree not to share your login details with anyone else.
If you log in to Brook Learn on a public or shared device, you should make sure that you logout when you have finished using it.
You are responsible for any activity that occurs under your account.
It is your responsibility to ensure that information you enter into Brook Learn is accurate to the best of your knowledge and you must not use Brook Learn to provide misleading information.
Security and Privacy
We take your privacy and security seriously. Your information will be protected in accordance with applicable laws and regulations. Please refer to our Privacy Policy for more information.
Prohibited Activities
You agree not to:
Use Brook Learn for any unlawful purpose or in violation of any laws or regulations.
Post or transmit any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
Attempt to interfere with the proper functioning of the LMS.
Violate the intellectual property rights of Brook or its partners.
Interfere with or disrupt any other User's use of the LMS.
Attempt to gain unauthorized access to the LMS or any other User's account.
Use the LMS, Courses or Content for any commercial purpose without the express written permission of Brook and, where applicable, its partners.
Content
The Content on Brook Learn is the property of Brook and its partners and is protected by copyright, trademark, and other laws.
You may not copy, modify, reproduce, distribute, transmit, display, or otherwise make available or exploit any Content without the express written permission of Brook and, where applicable, its partners.
You are solely responsible for any content you upload or share on the LMS. You agree to indemnify and hold harmless Brook and Eggu from any and all claims, losses, or damages arising from or relating to your content.
Termination of Access
Brook reserves the right to suspend or terminate your access to Brook Learn at any time, for any reason, without notice. If you believe your account has been suspended or terminated by mistake, please contact website@brook.org.uk.
You may terminate your account at any time by logging in to Brook Learn, navigating to the Profile page and selecting ‘Delete my Account’.
Changes to Terms
Brook reserves the right to update or modify these Terms of Use at any time without prior notice. Your continued use of Brook Learn after such changes will constitute your acceptance of the updated terms.
Disclaimer of Warranty
Brook Learn is provided "as is" and Brook makes no warranties, expressed or implied, regarding its accuracy, completeness, or fitness for a particular purpose.
Limitation of Liability
Brook Learn sits on a secure platform and is regularly tested for security. The chance of a data breach is very unlikely, but we cannot absolutely guarantee the safety of Brook Learn.
Brook and Eggu take all reasonable steps to ensure that Brook Learn will not introduce any viruses or similar. Brook and Eggu accept no liability for any viruses or similar introduced through your use of Brook Learn. You are responsible for ensuring that any device that you use to access Brook Learn is adequately configured in terms of security to protect against any risks.
In no event shall Brook or Eggu be liable for any direct, indirect, special, incidental, or consequential damages arising out of your use of, or your inability to use, Brook Learn.
Nothing in these Terms of Use shall limit or exclude liability for any matter for which it would be unlawful to do so.
Governing Law
These Terms of Use shall be governed by and construed in accordance with the laws of England and Wales and the exclusive jurisdiction of the English courts.
